Tex-Star A&I LLC – HVAC Service Plan Terms and Conditions

1. Agreement Overview
These Terms and Conditions ("Agreement") govern the HVAC service plans ("Plans") offered by Tex-Star A&I LLC ("Company") to customers ("Customer"). By enrolling in a Plan, the Customer agrees to these Terms and Conditions. Plans include Bronze, Silver, and Gold tiers, each offering specific services and benefits as outlined in plan descriptions.
2. Plan Coverage and Services
Each plan provides preventive maintenance and discounts designed to enhance system reliability and extend equipment life. Services included:

Bronze Plan

Biannual HVAC system cleaning

Condenser coil cleaning

21-point system inspection
-
10% discount on parts (excluding refrigerant)

10% discount on emergency repairs

Drain line cleaning

Silver Plan
Includes Bronze Plan features plus:

Filter replacement
-
1-year extended labor warranty
-
Priority scheduling
Gold Plan
Includes Silver Plan features plus:

Blower cleaning
-
2-year extended labor warranty
-
5% discount on quoted system installations
-
15% discount on emergency service fees
3. Term and Renewal

All plans are valid for 12 months from the date of activation.

Plans automatically renew unless cancelled at least 30 days prior to renewal date.

Renewal reminders may be provided but are not guaranteed.
4. Payments and Fees

Payment is due in full at the time of enrollment, unless otherwise agreed upon.

Manual payment options are available. The customer agrees to be contacted by a representative to arrange payment if online payment is not completed.

Tex-Star A&I LLC reserves the right to suspend plan benefits if payment is not received within 15 days of the due date.
5. Exclusions and Limitations
Plans do not cover:

System replacements or major component replacements

Damages due to misuse, acts of nature, neglect, or unauthorized modifications

Refrigerant cost (excluded from discounts)
-
Repairs caused by pre-existing conditions
-
Any services not explicitly listed in the selected plan
6. Scheduling and Access

All included services (e.g., inspections, cleanings) must be scheduled by the Customer within the plan year.

Missed or unclaimed visits will not carry over to the next plan year.

Customer must provide safe and reasonable access to all equipment.
7. Service Response and Priority

Silver and Gold members receive priority service scheduling.

While Tex-Star A&I LLC strives to provide prompt service, exact response times may vary based on availability and service volume.
8. Cancellation Policy

Customers may cancel their plan within 7 days of purchase for a full refund if no services have been rendered.

After 7 days, or if services have already been performed, no refunds will be issued.

Plans are non-transferable.
9. Liability and Warranty

Tex-Star A&I LLC is not liable for incidental, indirect, or consequential damages.

Labor warranty covers defects in workmanship for the stated duration (1 or 2 years depending on plan tier).

Warranty becomes void if third-party modifications are made to the covered system.
10. Modifications to Terms
Tex-Star A&I LLC reserves the right to modify these Terms and Conditions at any time. Continued participation in a Plan after changes constitutes acceptance of the new terms.
11. Governing Law
This Agreement is governed by the laws of the State of Texas, without regard to conflict of law principles.
